HANGTENFEET.COM GRANTS NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OTHER THAN THOSE WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY HANGTENFEET.COM OR THE STAFF SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS PARAGRAPH. HANGTENFEET.COM IS NOT RESPONSIBLE TO YOU FOR ANY DELAY IN TRANSMISSION OF CONTENT OR WEBSITE DOWNTIME. YOU ARE RESPONSIBLE FOR HAVING AND MAINTAINING THE PERSONAL COMPUTER EQUIPMENT AND INTERNET ACCESS NECESSARY TO MAKE USE OF THE SERVICE.
6. Limitation of Liability. IN NO EVENT SHALL HANGTENFEET.COM BE LIABLE TO YOU OR ANY OTHER PERSON FOR LOSS OF BUSINESS OR PROFITS OR FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF, OR INABILITY OT USE, THE SERVICE OR THE CONTENTS THEREOF, EVEN IF HANGTENFEET.COM WAS PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY OTHER CLAIM BY YOU OR BY ANY OTHER PERSON. TICKLETHEATER.COM IS NOT LIABLE FOR DAMAGES RESULTING FROM DISSEMINATING, FAILING TO DISSEMINATE, OR INCORRECTLY, OR INACCUARATELY DISSEMINATING ANY MATERIALS, DATA, ADVERTISMENT, OR OTHER COMMUNICATION AT OR THROUGH THE WEBSITE.
7. High Maintenance Members: Any Hangtenfeet.com member who requires an extraordinary amount of time from the moderators, staff or administration may either be asked to leave or, if unwilling to leave on their own, will be banned or have their membership terminated without notice. An "extraordinary amount of time" is defined as, but is not limited to: (1) excessive PMs or emails on the same topic, issue, complaint, or request by the member; (2) posting in a way that the Hangtenfeet.com staff finds requires moderation or attention much or most of the time; (3) excessively causing, creating, or adding to difficulties for other members; or (4) excessively participating in mutual hostility on the forum or to other members. The Hangtenfeet.com staff will not act as babysitters. We are only responsible for the website, forum, and its content. What goes on outside the website or forum we have no control over. While we will offer suggestions on how best to resolve conflicts between members, we will not continue to provide advice or support if you choose not to follow that advice. Should the difficulties continue, the members involved will be banned from the forum, with or without further warning.
8. Members Purchasing Material: Any Hangtenfeet.com member or buyer of material who purchases material from this site does so keeping in mind they are compliant with the terms and conditions of this agreement. The material purchased at Hangtenfeet.com are copyrighted and / or exclusively owned by Hangtenfeet.com or its authors or administrators. The content (including purchased video material) of this site may not be redistributed unless by in writing from Hangtenfeet.com, its authors, or administrators of the material. Redistribution of any part of the material which includes, video clips, trademarks, logos, text material, or any other part of the website is not allowed except by the express written consent of Hangtenfeet.com or its authors or administrators. Members violating any portion of this agreement will be asked to leave, and if unwilling to leave on their own, will be banned or have their membership terminated without notice. Such members may also be liable to criminal and civil penalties of any Federal and local laws violated.
9. Entire Agreement. This Agreement contains the entire agreement between YOU (the Subscriber) and HANGTENFEET.COM regarding Subscribers' use of the Service, Content and all materials directly and indirectly related thereto. This Agreement supersedes all prior written and oral understandings, writings, and representations and may only be amended upon notice by HANGTENFEET.COM.
YOU HEREBY AFFIRM THAT YOU HAVE READ THIS ENTIRE AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS BY CLICKING WHERE INDICATED BELOW.
BY ENTERING THIS SITE YOU INDICATE THAT YOU HAVE READ THIS MEMBERSHIP AGREEMENT IN ITS ENTIRETY, UNDERSTAND ITS TERMS, CONSENT TO ALL THE TERMS AND CONDITIONS SET FORTH IN THE AGREEMENT, REPRESENT AND WARRANT THAT YOU ARE CURRENTLY OVER THE AGE OF 18 YEARS (21 IN SOME AREAS) AND UNDERSTAND THAT MATERIALS PRESENTED AT THIS SITE INCLUDE NUDITY, VISUAL, AND AUDIO PRESENTATIONS OF SEXUAL SITUATIONS AND ADULT LANGUAGE.
IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT, ARE NOT OVER 18 YEARS OF AGE, OR ARE IN AN UNAUTHORIZED DOWNLOADING LOCATION, YOU SHOULD NOT JOIN.
